Note: These terms are a working draft subject to final lawyer review before first client signing, particularly the SEPA mandate clause, auto-renewal provision, and limitation of liability. Do not treat this version as a finalised binding document until that review is complete.

1. Who We Are

Labl.it Benelux is the official distribution entity for Labl.it Solutions Ltd. (registered in England and Wales, company no. 13041464, Tagus House, 9 Ocean Way, Southampton SO14 3TJ). The Benelux distribution is handled by Nicolas Six (BCE 1039763883), Brussels, Belgium.

These terms govern your use of the Labl.it service in Belgium, the Netherlands, and Luxembourg. For questions: nico@labl.it

2. B2B Service Only

The Labl.it service is exclusively intended for legal entities and individuals acting for professional purposes (restaurants, hotels, catering businesses, and similar food service operators). Consumer protection legislation does not apply to this agreement.

By placing an order or signing up for a trial, you confirm that you are acting in a professional capacity and that you have the authority to bind your organisation to these terms.

3. The Service

The Labl.it system consists of three components:

A hardware printing device (provided on loan under a commodat agreement — never sold)
A SaaS software platform and back-office dashboard, operated by Labl.it Solutions Ltd.
Proprietary label rolls and consumables, supplied by Labl.it Benelux

Access to the software platform and the loan of the hardware device are bundled into the subscription fee. Label rolls and other consumables are billed separately.

4. Free Trial

Every new client receives a 14-day free trial.
No charge is applied during the trial period.
If you choose not to continue, you return the device at no cost. Return shipping is arranged and covered by Labl.it Benelux.
If you choose to continue, your selected subscription plan activates at the end of the trial period.

5. Subscriptions and Pricing

Annual plan: €39/month per device, billed €468 annually.
Monthly plan: €49/month per device, billed monthly.
All prices exclude VAT where applicable.
Label rolls and other consumables are billed separately at the rates communicated at setup.
Prices may be adjusted with 30 days' written notice. Any price adjustment during an active subscription term takes effect at the next renewal date, not mid-term.

6. Auto-Renewal

Subscriptions renew automatically at the end of each subscription period unless you provide written notice of cancellation before the renewal date. On the renewal date, the payment method on file is charged for the next period.

7. Payment via SEPA Direct Debit

By subscribing, you authorise Labl.it Benelux (via Stripe Technology Europe Ltd. as payment processor) to collect payments from your nominated bank account by SEPA Direct Debit. This authorisation constitutes a SEPA mandate. You will be notified of each collection at least 2 calendar days in advance, as agreed at sign-up.

You may cancel or amend your SEPA mandate at any time by contacting us at nico@labl.it. Cancellation of the mandate does not cancel your subscription.

Pursuant to the Belgian Act of 2 August 2002 on combating late payment in commercial transactions, any invoice unpaid on its due date automatically incurs interest at the applicable statutory B2B rate, plus a flat administrative fee equal to 10% of the outstanding amount (minimum €125), without prior notice being required.

8. Cancellation

Monthly plan: cancel at any time with 30 days' written notice. No early termination penalty.
Annual plan: the subscription runs for the full 12-month period from activation. Cancel before the renewal date to prevent auto-renewal. No mid-term exit or refund. Early cancellation terms are available on request and subject to written agreement.
On cancellation, Labl.it Benelux provides a prepaid return shipping label. The device must be returned within 14 days of the end of the service period.
Subscription fees continue to accrue until the device is received back in acceptable condition.
Service continuity protection: if the distribution arrangement between Labl.it Benelux and Labl.it Solutions Ltd. is modified or terminated, your active subscription will continue uninterrupted for the longer of 60 calendar days or the end of your current billing period. Annual subscribers will receive a pro-rata refund for any full months paid beyond that window. The device will only be collected after this continuity period has been honoured.

9. Device and Hardware

The Labl.it device is provided on loan under a commodat agreement (Belgian Civil Code, arts. 1875–1891). The device is never sold. Ownership of the device remains with Labl.it Solutions Ltd. at all times, made available to clients through Nicolas Six (Labl.it Benelux). The subscription fee covers access to the device and software, not purchase of the device.

The device must be returned in good condition upon cancellation or end of trial. Normal wear and tear is expected. Risk of loss, theft, and damage passes to the client upon delivery.

The following constitute client-side damage and are chargeable:

Accidental damage (drops, liquid ingress, cracked or smashed screen, heat damage, melted casing)
Opening or attempting to repair internal components
Contaminated internal label sensor
General loss or theft of device
Battery damage caused by use of an incorrect charger
Storage in an inappropriate environment

Repair and replacement charges (excl. VAT):

Custom repair fees may apply for damage not listed above but will not exceed the full device replacement cost.

10. Label Rolls and Consumables

Only Labl.it-supplied label rolls may be used in the device. Use of third-party or non-approved label rolls is likely to cause permanent damage to the print head and internal mechanisms, and automatically voids all hardware warranties. Labl.it Benelux accepts no liability for label errors, device malfunction, or regulatory penalties resulting from the use of non-approved consumables.

The first label roll pack (starter pack) is included with the device at setup. Reorder pricing is communicated at setup and is subject to change.

11. Customer Obligations

During the subscription period, you agree to:

Keep the device in good working order and store it in a clean, suitable environment
Use only Labl.it-supplied label rolls
Not modify, disassemble, or attempt to repair the device internally
Not remove, alter, or obscure any labels, markings, or serial numbers on the device
Report any fault, suspected fault, loss, or damage to us promptly
Allow Labl.it representatives reasonable access to inspect the device if required
Return the device at the end of the subscription or make it available for collection

12. Food Safety

The Labl.it device is designed to assist with food labelling processes. It does not replace or guarantee compliance with any specific food safety regulation, HACCP plan, or allergen labelling requirement. It is your responsibility as a business operator to verify label content accuracy, maintain appropriate food safety procedures, and ensure compliance with applicable hygiene and allergen legislation. Labl.it Benelux is not liable for regulatory penalties, food safety incidents, or allergic reactions arising from label content or label errors, regardless of cause.

13. Data and Privacy

Your personal and business data is processed in accordance with our Privacy Policy. Form submissions are handled by Formspree. Payment data is processed by Stripe. Analytics and advertising tracking are loaded only with your explicit consent. Governing law for data processing is Belgian law (EU GDPR as implemented in Belgium).

14. Limitation of Liability

Labl.it Benelux's maximum aggregate liability for any claim arising under or in connection with this agreement is limited to the total fees paid by you to Labl.it Benelux in the six months preceding the claim. Labl.it Benelux is not liable for indirect losses, loss of profit, loss of revenue, business interruption, or data loss in any circumstances.

Nothing in these terms limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) gross negligence or wilful misconduct.

15. Governing Law and Jurisdiction

These terms are governed by Belgian law. Any dispute that cannot be resolved amicably within 30 days of written notice is subject to the exclusive jurisdiction of the Enterprise Court (Tribunal de l'entreprise / Ondernemingsrechtbank) of Brussels.

1. Qui sommes-nous

Labl.it Benelux est l'entité de distribution officielle de Labl.it Solutions Ltd. (société enregistrée en Angleterre et au Pays de Galles, no. 13041464, Tagus House, 9 Ocean Way, Southampton SO14 3TJ). La distribution au Benelux est assurée par Nicolas Six (BCE 1039763883), Bruxelles, Belgique.

Les présentes conditions régissent votre utilisation du service Labl.it en Belgique, aux Pays-Bas et au Luxembourg. Pour toute question : nico@labl.it

2. Service exclusivement B2B

Le service Labl.it est exclusivement destiné aux personnes morales et aux personnes physiques agissant à des fins professionnelles (restaurants, hôtels, entreprises de restauration collective et opérateurs similaires). La législation relative à la protection des consommateurs ne s'applique pas au présent accord.

En passant une commande ou en s'inscrivant pour un essai, vous confirmez agir dans un cadre professionnel et avoir le pouvoir d'engager votre organisation vis-à-vis des présentes conditions.

3. Le service

Le système Labl.it comprend trois composantes :

Un appareil d'impression (mis à disposition en prêt dans le cadre d'un contrat de commodat, jamais vendu)
Une plateforme SaaS et un tableau de bord back-office, exploités par Labl.it Solutions Ltd.
Des rouleaux d'étiquettes et des consommables propriétaires, fournis par Labl.it Benelux

L'accès à la plateforme logicielle et le prêt de l'appareil sont inclus dans l'abonnement. Les rouleaux d'étiquettes et autres consommables sont facturés séparément.

4. Essai gratuit

Chaque nouveau client bénéficie d'un essai gratuit de 14 jours.
Aucun frais n'est appliqué durant la période d'essai.
Si vous choisissez de ne pas poursuivre, vous retournez l'appareil sans frais. Le retour est organisé et pris en charge par Labl.it Benelux.
Si vous choisissez de continuer, la formule d'abonnement sélectionnée prend effet à la fin de la période d'essai.

5. Abonnements et tarifs

Formule annuelle : 39 €/mois par appareil, facturés 468 € annuellement.
Formule mensuelle : 49 €/mois par appareil, facturés mensuellement.
Tous les prix s'entendent hors TVA, le cas échéant.
Les rouleaux d'étiquettes et autres consommables sont facturés séparément aux tarifs communiqués lors de la mise en service.
Les tarifs peuvent être modifiés moyennant un préavis écrit de 30 jours. Toute modification tarifaire en cours d'abonnement prend effet à la prochaine date de renouvellement.

6. Renouvellement automatique

Les abonnements se renouvellent automatiquement à l'échéance de chaque période, sauf résiliation notifiée par écrit avant cette date. À la date de renouvellement, le moyen de paiement enregistré est débité pour la période suivante.

7. Paiement par prélèvement SEPA

En souscrivant, vous autorisez Labl.it Benelux (via Stripe Technology Europe Ltd. en tant que prestataire de paiement) à prélever les paiements sur votre compte bancaire par prélèvement SEPA. Cette autorisation constitue un mandat SEPA. Vous serez informé de chaque prélèvement au moins 2 jours calendrier à l'avance, conformément à l'accord conclu lors de l'inscription.

Vous pouvez annuler ou modifier votre mandat SEPA à tout moment en nous contactant à l'adresse nico@labl.it. L'annulation du mandat ne met pas fin à l'abonnement.

Conformément à la loi belge du 2 août 2002 concernant la lutte contre le retard de paiement dans les transactions commerciales, toute facture impayée à son échéance génère automatiquement des intérêts au taux légal B2B applicable, ainsi qu'une indemnité forfaitaire égale à 10 % du montant dû (minimum 125 €), sans mise en demeure préalable.

8. Résiliation

Formule mensuelle : résiliable à tout moment avec un préavis écrit de 30 jours. Aucune pénalité de résiliation anticipée.
Formule annuelle : l'abonnement court pour la totalité de la période de 12 mois à compter de l'activation. Résiliez avant la date de renouvellement pour éviter le renouvellement automatique. Aucune sortie anticipée ni remboursement. Des conditions de résiliation anticipée sont disponibles sur demande et sous réserve d'un accord écrit.
À la résiliation, Labl.it Benelux fournit une étiquette de retour prépayée. L'appareil doit être retourné dans les 14 jours suivant la fin de la période de service.
Les frais d'abonnement continuent de courir jusqu'à la réception de l'appareil en bon état.
Protection de continuité de service : si l'accord de distribution entre Labl.it Benelux et Labl.it Solutions Ltd. est modifié ou résilié, votre abonnement actif se poursuivra sans interruption pendant 60 jours calendrier minimum ou jusqu'à la fin de votre période de facturation en cours, selon la durée la plus longue. Les abonnés annuels recevront un remboursement au prorata des mois complets payés au-delà de cette fenêtre. L'appareil ne sera repris qu'après l'expiration de cette période de continuité.

9. Appareil et matériel

L'appareil Labl.it est mis à disposition dans le cadre d'un commodat (Code civil belge, art. 1875–1891). Il n'est jamais vendu. La propriété de l'appareil reste en tout temps celle de Labl.it Solutions Ltd., mise à la disposition des clients par l'intermédiaire de Nicolas Six (Labl.it Benelux). L'abonnement donne accès à l'appareil et au logiciel, sans en conférer la propriété.

L'appareil doit être restitué en bon état à la résiliation ou à la fin de l'essai. L'usure normale est acceptée. Le risque de perte, de vol et de dommage est transféré au client dès la livraison.

Les éléments suivants constituent des dommages imputables au client et sont facturables :

Dommages accidentels (chocs, infiltrations de liquide, écran fissuré ou brisé, dommages thermiques, boîtier fondu)
Ouverture ou tentative de réparation des composants internes
Capteur d'étiquettes interne contaminé
Perte ou vol de l'appareil
Dommages à la batterie dus à l'utilisation d'un chargeur non conforme
Stockage dans un environnement inadapté

Frais de réparation et de remplacement (hors TVA) :

Des frais de réparation personnalisés peuvent s'appliquer pour les dommages non listés ci-dessus, mais ne dépasseront pas le coût de remplacement complet de l'appareil.

10. Rouleaux d'étiquettes et consommables

Seuls les rouleaux d'étiquettes fournis par Labl.it peuvent être utilisés dans l'appareil. L'utilisation de rouleaux tiers ou non approuvés est susceptible de causer des dommages permanents à la tête d'impression et aux mécanismes internes, et annule automatiquement toute garantie matérielle. Labl.it Benelux décline toute responsabilité pour les erreurs d'étiquetage, les dysfonctionnements de l'appareil ou les sanctions réglementaires résultant de l'utilisation de consommables non approuvés.

Le premier lot de rouleaux (kit de démarrage) est inclus avec l'appareil lors de la mise en service. Le tarif des réapprovisionnements est communiqué à la mise en service et peut être modifié.

11. Obligations du client

Pendant la durée de l'abonnement, vous vous engagez à :

Maintenir l'appareil en bon état de fonctionnement et le stocker dans un environnement propre et adapté
N'utiliser que les rouleaux d'étiquettes fournis par Labl.it
Ne pas modifier, démonter ni tenter de réparer l'appareil en interne
Ne pas retirer, modifier ni masquer les étiquettes, marquages ou numéros de série de l'appareil
Signaler rapidement tout défaut, panne suspectée, perte ou dommage
Permettre aux représentants de Labl.it d'inspecter raisonnablement l'appareil si nécessaire
Restituer l'appareil à la fin de l'abonnement ou le mettre à disposition pour enlèvement

12. Sécurité alimentaire

L'appareil Labl.it est conçu pour faciliter les processus d'étiquetage alimentaire. Il ne remplace pas et ne garantit pas la conformité à une réglementation spécifique en matière de sécurité alimentaire, à un plan HACCP ou à une obligation d'étiquetage des allergènes. Il vous appartient, en tant qu'exploitant, de vérifier l'exactitude du contenu des étiquettes, de maintenir des procédures de sécurité alimentaire appropriées et de veiller au respect de la législation applicable en matière d'hygiène et d'allergènes. Labl.it Benelux n'est pas responsable des sanctions réglementaires, des incidents de sécurité alimentaire ou des réactions allergiques résultant du contenu ou d'erreurs d'étiquetage, quelle qu'en soit la cause.

13. Données et vie privée

Vos données personnelles et professionnelles sont traitées conformément à notre Politique de confidentialité. Les soumissions de formulaires sont traitées par Formspree. Les données de paiement sont traitées par Stripe. Le suivi analytique et publicitaire n'est activé qu'avec votre consentement explicite. La loi belge (RGPD tel qu'appliqué en Belgique) est applicable au traitement des données.

14. Limitation de responsabilité

La responsabilité totale de Labl.it Benelux pour toute réclamation découlant du présent accord ou y étant liée est limitée au montant total des frais versés par le client au cours des six mois précédant le sinistre. Labl.it Benelux n'est pas responsable des pertes indirectes, des pertes de bénéfices, des pertes de chiffre d'affaires, des interruptions d'activité ou des pertes de données, en toute circonstance.

Rien dans les présentes conditions ne limite la responsabilité pour : (a) le décès ou les blessures corporelles causés par la négligence ; (b) la fraude ou les fausses déclarations frauduleuses ; (c) la faute lourde ou le dol.

15. Droit applicable et juridiction

Les présentes conditions sont régies par le droit belge. Tout litige ne pouvant être résolu à l'amiable dans les 30 jours suivant une notification écrite est soumis à la compétence exclusive du Tribunal de l'entreprise de Bruxelles.

Opmerking: Deze voorwaarden zijn een werkversie en worden nog juridisch gecontroleerd vóór de eerste klantondertekening, in het bijzonder de SEPA-mandaatclausule, de automatische verlengingsbepaling en de aansprakelijkheidsbeperking. Gebruik deze versie niet als definitief bindend document tot die controle is afgerond.

1. Wie zijn wij

Labl.it Benelux is de officiële distributieentiteit voor Labl.it Solutions Ltd. (geregistreerd in Engeland en Wales, ondernemingsnummer 13041464, Tagus House, 9 Ocean Way, Southampton SO14 3TJ). De Benelux-distributie wordt verzorgd door Nicolas Six (KBO 1039763883), Brussel, België.

Deze voorwaarden zijn van toepassing op uw gebruik van de Labl.it-dienst in België, Nederland en Luxemburg. Voor vragen: nico@labl.it

2. Uitsluitend B2B-dienst

De Labl.it-dienst is uitsluitend bestemd voor rechtspersonen en natuurlijke personen die handelen in het kader van hun professionele activiteit (restaurants, hotels, cateringbedrijven en vergelijkbare exploitanten). De consumentenwetgeving is niet van toepassing op deze overeenkomst.

Door een bestelling te plaatsen of in te schrijven voor een proefperiode, bevestigt u dat u handelt in een professionele hoedanigheid en gemachtigd bent uw organisatie te verbinden aan deze voorwaarden.

3. De dienst

Het Labl.it-systeem bestaat uit drie onderdelen:

Een hardware-printtoestel (ter beschikking gesteld via een bruikleenovereenkomst, nooit verkocht)
Een SaaS-softwareplatform en back-officedashboard, beheerd door Labl.it Solutions Ltd.
Merkgebonden etikettenrollen en verbruiksartikelen, geleverd door Labl.it Benelux

Toegang tot het softwareplatform en het bruikleen van het toestel zijn inbegrepen in het abonnement. Etikettenrollen en andere verbruiksartikelen worden apart gefactureerd.

4. Gratis proefperiode

Elke nieuwe klant ontvangt een gratis proefperiode van 14 dagen.
Er worden geen kosten aangerekend tijdens de proefperiode.
Kiest u ervoor niet verder te gaan, dan retourneert u het toestel zonder kosten. De retourverzending wordt georganiseerd en betaald door Labl.it Benelux.
Kiest u ervoor door te gaan, dan gaat het geselecteerde abonnement in aan het einde van de proefperiode.

5. Abonnementen en tarieven

Jaarformule: €39/maand per toestel, jaarlijks gefactureerd als €468.
Maandformule: €49/maand per toestel, maandelijks gefactureerd.
Alle prijzen zijn exclusief btw, tenzij anders vermeld.
Etikettenrollen en andere verbruiksartikelen worden apart gefactureerd aan de bij ingebruikname meegedeelde tarieven.
Tarieven kunnen worden aangepast mits 30 dagen schriftelijke opzegtermijn. Elke tariefwijziging tijdens een lopend abonnement gaat in op de volgende verlengingsdatum.

6. Automatische verlenging

Abonnementen worden automatisch verlengd aan het einde van elke abonnementsperiode, tenzij u vóór de verlengingsdatum schriftelijk opzegt. Op de verlengingsdatum wordt het geregistreerde betaalmiddel belast voor de volgende periode.

7. Betaling via SEPA-domiciliëring

Door in te schrijven, machtigt u Labl.it Benelux (via Stripe Technology Europe Ltd. als betalingsverwerker) om betalingen te innen van uw opgegeven bankrekening via SEPA-domiciliëring. Deze machtiging vormt een SEPA-mandaat. U wordt van elke inning minstens 2 kalenderdagen op voorhand in kennis gesteld, zoals overeengekomen bij inschrijving.

U kunt uw SEPA-mandaat op elk moment annuleren of wijzigen door ons te contacteren via nico@labl.it. Annulering van het mandaat beëindigt het abonnement niet.

Overeenkomstig de Belgische wet van 2 augustus 2002 betreffende de bestrijding van betalingsachterstand bij handelstransacties brengt elke factuur die op de vervaldag onbetaald blijft automatisch rente aan het toepasselijke wettelijke B2B-tarief met zich mee, alsook een forfaitaire administratieve vergoeding van 10% van het uitstaande bedrag (minimum €125), zonder dat voorafgaande ingebrekestelling vereist is.

8. Opzegging

Maandformule: op elk moment opzegbaar met een schriftelijke opzegtermijn van 30 dagen. Geen boete bij vroegtijdige beëindiging.
Jaarformule: het abonnement loopt voor de volledige periode van 12 maanden vanaf activering. Zeg op vóór de verlengingsdatum om automatische verlenging te voorkomen. Geen vroegtijdige uitstap of terugbetaling. Voorwaarden voor vroegtijdige opzegging zijn beschikbaar op verzoek en vereisen een schriftelijk akkoord.
Bij opzegging voorziet Labl.it Benelux in een prepaid retourzendingslabel. Het toestel moet worden geretourneerd binnen 14 dagen na het einde van de dienstperiode.
Abonnementskosten blijven lopen totdat het toestel in aanvaardbare staat is ontvangen.
Dienstcontinuïteitsbescherming: als de distributieovereenkomst tussen Labl.it Benelux en Labl.it Solutions Ltd. wordt gewijzigd of beëindigd, loopt uw actief abonnement ononderbroken door gedurende minimaal 60 kalenderdagen of tot het einde van uw huidige factureringsperiode, afhankelijk van wat het langst is. Jaarabonnees ontvangen een pro-ratavergoeding voor volledige maanden betaald na dat venster. Het toestel wordt pas opgehaald na afloop van deze continuïteitsperiode.

9. Toestel en hardware

Het Labl.it-toestel wordt ter beschikking gesteld via een bruikleenovereenkomst (Belgisch Burgerlijk Wetboek, art. 1875–1891). Het toestel wordt nooit verkocht. De eigendom van het toestel blijft te allen tijde bij Labl.it Solutions Ltd., ter beschikking gesteld aan klanten via Nicolas Six (Labl.it Benelux). Het abonnement geeft toegang tot het toestel en de software, niet het eigendomsrecht ervan.

Het toestel moet in goede staat worden geretourneerd bij opzegging of na afloop van de proefperiode. Normale slijtage is aanvaardbaar. Het risico van verlies, diefstal en schade gaat over op de klant bij levering.

De volgende elementen vormen schade ten laste van de klant en zijn factureerbaar:

Accidentele schade (vallen, vochtindringing, gebarsten of gebroken scherm, hitteschade, gesmolten behuizing)
Openen of poging tot reparatie van interne componenten
Besmette interne etikettensensor
Verlies of diefstal van het toestel
Batterijschade door gebruik van een onjuiste oplader
Opslag in een ongeschikte omgeving

Aangepaste reparatiekosten kunnen van toepassing zijn voor schade die niet in de bovenstaande tabel is opgenomen, maar zullen nooit hoger zijn dan de volledige vervangingskosten van het toestel.

10. Etikettenrollen en verbruiksartikelen

Uitsluitend door Labl.it geleverde etikettenrollen mogen in het toestel worden gebruikt. Het gebruik van rollen van derden of niet-goedgekeurde rollen kan permanente schade veroorzaken aan de printkop en de interne mechanismen, en maakt automatisch alle hardwaregaranties nietig. Labl.it Benelux aanvaardt geen aansprakelijkheid voor etiketteringsfouten, toestelstoringen of regelgevende sancties die voortvloeien uit het gebruik van niet-goedgekeurde verbruiksartikelen.

Het eerste lot etikettenrollen (starterkit) is inbegrepen bij het toestel bij ingebruikname. Het tarief voor nabestellingen wordt meegedeeld bij ingebruikname en kan worden gewijzigd.

11. Verplichtingen van de klant

Tijdens de abonnementsperiode verbindt u zich ertoe:

Het toestel in goede staat te houden en op te slaan in een schone, geschikte omgeving
Uitsluitend door Labl.it geleverde etikettenrollen te gebruiken
Het toestel niet intern te wijzigen, te demonteren of te proberen te repareren
Labels, markeringen of serienummers op het toestel niet te verwijderen, te wijzigen of te verbergen
Elk defect, vermoeden van defect, verlies of schade snel te melden
Vertegenwoordigers van Labl.it een redelijke toegang te verlenen om het toestel te inspecteren indien nodig
Het toestel aan het einde van het abonnement te retourneren of beschikbaar te stellen voor ophaling

12. Voedselveiligheid

Het Labl.it-toestel is ontworpen om etiketteringsprocessen voor voedsel te ondersteunen. Het vervangt de naleving van specifieke voedselveiligheidsregelgeving, een HACCP-plan of allergenenverplichtingen niet en garandeert deze ook niet. Als exploitant is het uw verantwoordelijkheid de nauwkeurigheid van etiketinhoud te verifiëren, geschikte voedselveiligheidsprocedures te handhaven en de toepasselijke hygiëne- en allergenenregelgeving na te leven. Labl.it Benelux is niet aansprakelijk voor regelgevende sancties, voedselveiligheidsincidenten of allergische reacties die voortvloeien uit etiketinhoud of etiketteringsfouten, ongeacht de oorzaak.

13. Gegevens en privacy

Uw persoonlijke en zakelijke gegevens worden verwerkt overeenkomstig ons Privacybeleid. Formulierinzendingen worden verwerkt door Formspree. Betalingsgegevens worden verwerkt door Stripe. Analytische en reclamedoeleinden worden enkel geladen met uw uitdrukkelijke toestemming. Het Belgisch recht (AVG zoals toegepast in België) is van toepassing op de gegevensverwerking.

14. Beperking van aansprakelijkheid

De totale aansprakelijkheid van Labl.it Benelux voor elke vordering die voortvloeit uit of verband houdt met deze overeenkomst is beperkt tot het totaalbedrag van de vergoedingen betaald door de klant in de zes maanden voorafgaand aan de vordering. Labl.it Benelux is in geen geval aansprakelijk voor indirecte schade, winstderving, omzetderving, bedrijfsonderbreking of gegevensverlies.

Niets in deze voorwaarden beperkt de aansprakelijkheid voor: (a) overlijden of lichamelijk letsel veroorzaakt door nalatigheid; (b) fraude of frauduleuze onjuiste voorstelling van zaken; (c) grove nalatigheid of opzet.

15. Toepasselijk recht en bevoegde rechter

Deze voorwaarden worden beheerst door het Belgisch recht. Elk geschil dat niet minnelijk kan worden opgelost binnen 30 dagen na een schriftelijke kennisgeving valt onder de exclusieve bevoegdheid van de Ondernemingsrechtbank van Brussel.
